Terms of Service

This Terms of Service Agreement (hereinafter referred to as the “Agreement”) is entered into by and between Moving Parcels (hereinafter referred to as the “Platform”) and the Vendor (hereinafter referred to as the “Vendor”) who registers to sell products and/or services on the Platform. By registering as a Vendor, you agree to comply with and be bound by the following terms and conditions.

Definitions

1.1 Platform: Refers to Moving Parcels, its website, services, and systems.
1.2 Vendor: Any individual or entity registered to sell products or services on the Platform.
1.3 Customer: A user who purchases products or services through the Platform.
1.4 Products: Goods or services offered for sale by the Vendor on the Platform.

Vendor Eligibility

2.1 Vendors must be at least 18 years old and legally capable of entering into binding contracts.
2.2 Vendors must provide accurate and up-to-date information during the registration process.

Vendor Obligations

3.1 Vendors agree to list only lawful, safe, and accurately described products.
3.2 Vendors must honor all orders placed by Customers unless a valid reason exists for cancellation.
3.3 Vendors are responsible for managing inventory, shipping, and returns for their products.7
3.4 Vendors must comply with all applicable laws, including tax laws, consumer protection laws, and intellectual property laws.
3.5 Vendors shall not engage in activities that may harm the reputation of the Platform, such as fraudulent practices or unethical conduct.

Platform Obligations

4.1 The Platform provides a digital marketplace for Vendors to showcase and sell their products.
4.2 The Platform facilitates transactions between Vendors and Customers but is not a party to the sale.
4.3 The Platform will process payments on behalf of the Vendor and remit funds in accordance with the payment schedule.

Fees and Payments

5.1 Vendors agree to pay any applicable listing, transaction, or subscription fees as determined by the Platform.
5.2 The Platform reserves the right to adjust fees with reasonable notice to Vendors.
5.3 Payment for sales will be remitted to Vendors after deducting applicable fees, taxes, and refunds.

Intellectual Property

6.1 Vendors retain ownership of their trademarks, logos, and other intellectual property but grant the Platform a non-exclusive, worldwide license to use such materials for promotional purposes.
6.2 Vendors warrant that all content they upload, including product images and descriptions, does not infringe on any third-party rights.

Prohibited Activities

Vendors agree not to:

Sell counterfeit, illegal, or prohibited products.
Misrepresent product details or engage in deceptive practices.
Collect or misuse customer data.

Dispute Resolution

8.1 Disputes between Vendors and Customers will be resolved according to the Platform’s dispute resolution policy.
8.2 Disputes between Vendors and the Platform shall be resolved through arbitration in accordance with the laws of The Republic of South Africa.

Termination

9.1 Vendors may terminate their account at any time by providing written notice to the Platform.
9.2 The Platform reserves the right to suspend or terminate a Vendor’s account for breach of this Agreement or any applicable policies.

Limitation of Liability

The Platform shall not be liable for:

Any losses or damages arising from the sale of products by Vendors.
Vendor’s non-compliance with applicable laws.

Amendments

The Platform reserves the right to amend this Agreement at any time. Vendors will be notified of changes via email or the Platform’s dashboard, and continued use of the Platform constitutes acceptance of the updated terms.

Governing Law

This Agreement shall be governed by and construed in accordance with the laws of The Republic of South Africa.

Entire Agreement

This Agreement constitutes the entire understanding between the Platform and the Vendor, superseding any prior agreements.
By registering as a Vendor on Shop.MovingParcels.co.za, you acknowledge that you have read, understood, and agree to abide by this Terms of Service Agreement.
